Terms & Conditions

These Terms and Conditions refer the contract between The Media Gurus trading as Holiday Home Websites (HHW) and the individual(s) who commissions the website(s) for and behalf of themselves, their company or their client, to be referred to hereinafter as the “Customer”.

1. HHW shall provide the agreed website design and links as set out in the contract.

2. HHW shall provide the Customer with a production schedule following receipt of the signed contract.

3. HHW shall use all commercially reasonable efforts to produce and deliver the website as

   agreed in the contract.

4. The Production Schedule may be extended by prior mutual agreement by the Customer and

   HHW due to events beyond either party’s reasonable control.

5. The Customer shall provide all production and reference materials by the agreed date and

   shall be legally responsible for all permissions and rights required for their use.

6. HHW shall retain all rights and titles to the production and to the intellectual property

   rights constituted until payment in full has been received.

7. All intellectual property rights in the look and feel of the customised product arising from

   the Customer Materials vests and is assigned with full title guarantee in perpetuity to the

   Customer once payment in full has been received.

8. HHW grants the Customer worldwide, non-transferable license to use the website design in

   the format developed for the Customer by HHW and as delivered under the terms of this contract. 

9. In accordance with this contract the Customer hereby grants HHW a fully paid, perpetual,

   worldwide, non-exclusive license to use the Customer Materials in connection with the use,

   distribution and display of the product. 

10. The Customer must provide evidence that they have authority to promote the property.

11. Construction of websites will commence on receipt of e-mail, fax or postal confirmation.

12. Construction of websites can only commence once all the content material has been received.

13. The Customer must provide written authority for usage of any photos or logos.

14. The Customers must apply for links to third parties themselves e.g. Airlines, Ferry operators etc.

15. The Customer will be provided with a link to view and approve the website before it goes live.

16. You will be invoiced once e-mailed, faxed or written approval has been received.

17. As soon as full payment has been received the website go live.

18. Holiday Home Websites will provide maintenance of the website and e-mail accounts for a

    period of one year.

19. The selected domain name of the website will be purchased on behalf of the Customer.

20. Ownership of the domain name will be transferred after full payment has be received.

21. Two e-mail accounts in the same domain name of the website will set up for the Customer.

22. Full instruction and maintenance will be provided for one year.

23. Transfer of control of the website may be made at any time.

24. No reduction or refund will be made should control of the website be transferred.

25. Holiday Home Websites will no longer be responsible for management of the hosting if

    control of the website is transferred elsewhere.

26. The Customer is legally responsible for all content of the website.

27. The Customer indemnifies Holiday Home Websites  against and legal action through any

    infringement of copyrights, trademarks, trade secrets, proprietary rights or laws, in the

    commission of the website and the materials supplied.

28. Cancellation: 50% of the order value is payable if the customer cancels the contract after

    production has commenced.

29. HHW shall include its branding in the production, together with hyperlinks to our web-sites.
